Terms and Conditions (T&C) for HuntedByNight Photography
1. Scope
These Terms and Conditions apply to all digital products and content offered by HuntedByNight Photography via huntedbynight.com and presetsbynight.tentary.com.
2. Contract Conclusion
The presentation of products constitutes a binding offer. A contract is concluded when the customer completes the purchase process and payment is successfully processed.
3. Digital Products
All products are digital goods (e.g. Lightroom presets, digital publications such as magazine issues) delivered via download or access link. No physical shipping is included unless explicitly stated.
4. Payment
Payment is due immediately upon purchase and is processed via PayPal or Stripe.
5. Right of Withdrawal
Due to the nature of digital content, the right of withdrawal expires once the execution of the contract has begun, provided that the customer has expressly agreed to this and acknowledged the loss of the right of withdrawal (§ 356 (5) BGB).
6. Usage Rights
All content is protected by copyright.
Customers receive a non-exclusive, non-transferable license to use the products for personal and commercial purposes.
The following is strictly prohibited:

7. Liability
We are liable without limitation for damages caused by intent or gross negligence.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal duties), limited to foreseeable damages typical for the contract.
Liability for loss of data is limited to the typical recovery effort.
8. Final Provisions
German law applies. If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
